Use of this web site assumes that you fully accept and agree to the Terms and Conditions set forth in this document. These Terms & Conditions also state that by signing up, you are certifying you have read and understand our Terms & Conditions as well as our Privacy Policy. Furthermore, you are agreeing to the contents and conditions listed in each.

4th Base Marketing LLC reserves the right to change the StrokeNut Terms & Conditions at any time, for any reason, with short notice. We also reserve the right to change the methods through which free items are earned. This may include, but is not limited to, increasing or decreasing the number of credits required to redeem a reward or earn from a subscription or sign-up. We may also add or remove any product listed as an incentive at any time. If we replace a product, the new product may not be of equal value.

We reserve the right to change the products, rewards or offers at any time, for any reason.

DEFINITIONS
  1. STROKENUT : StrokeNut is an incentive marketing program owned and managed by 4th Base Marketing LLC.
  2. STROKES : Strokes are a fictional measurement of a user's loyalty to strokenut.com and the sponsors of strokenut.com. STROKES HAVE NO CASH VALUE AND ARE NON-TRANSFERRABLE. Herein, "strokes" may be referred to as "credits" or "points". Strokes may not be sold, bartered or bequeathed.

I. Membership
  1. Members must be 18 years of age or other minimum age to view adult erotica and to enter into a contract (this document) as dictated by local, state or federal law.
  2. All shipping addresses must be in the United States of America. Addresses not in the United States of America will not have items shipped to.
  3. Items may not be shipped to PO Boxes.
  4. Referrals cannot be transferred or donated from one account to another. Two or more accounts cannot be merged into one account.
  5. If your account is placed on hold, you are not permitted to create another account. Any user who is found to create an account when they already have an account that is on hold will be banned from StrokeNut.
  6. Any unauthorized use, entry, or hacking into strokenut.com is illegal and is punishable by law. The slightest violation of any law will provide sufficient impetus for us to prosecute the offender to the fullest extent of that law.
  7. Corporations or other business entities are not eligible to become Members.

II. Site Subscription Offers

  1. Receiving credit for a sign-up cannot be guaranteed. If you believe that you have completed a subscription correctly, please open a support ticket with your name, account name, e-mail address, site name, and the date that you subscribed. We will try to give you credit for that subscription, but we cannot guarantee that you will receive any form of credit.
  2. Users must complete the offer by using the link provided on the strokenut.com site listing. If you go to the web site directly, use another affiliates link, or go to the offer site by any means other than through this web site, we reserve the right not to give you credit for that offer.
  3. Users are responsible for saving all confirmation e-mails received by affiliate companies. These e-mails might be needed in the case that manual credit for an offer needs to be given.
  4. 4th Base Marketing is not responsible for any unknown or unexpected charges that you receive from one or more of our subscription offers. Read the offer terms and conditions before signing up. Users suspecting that we are linking to dishonest sites should create a support ticket with us so that we may investigate for our own purposes. However, we cannot accept the responsibility of the actions of other sites.

III. Rewards

  1. 4th Base Marketing LLC is not responsible for the availability of a reward. A product may be from time to time backordered or substituted. You will be given the opportunity to accept or decline a substituted award prior to shipment. After shipment a reward may not be returned for credit or exchanged.
  2. Physical product rewards are sent via an insured and guaranteed receipt form of delivery (Signature Required). Items lost in transit, damaged in transit or claimed undelivered will be the resposibility of the courier and not 4th Base Marketing LLC.
  3. Users outside of the United States cannot have products shipped to them. They are only eligible for rewards that are deliverable electronically (namely, gift certificate codes)
  4. We reserve the right to change or remove any free gift or bonus offer offered on any of our web sites at any time. If a free gift is replaced by a different gift, the new gift may not be of equal value to the gift being replaced.

IV. Orders

  1. 4th Base Marketing LLC is not responsible for lost orders due to, but not limited to, incorrect shipping addresses or faults on behalf of the shipping companies. Items requiring physical shipment are sent insured and with guaranteed receipt (Signature Required). Lost, stolen and damaged items are the responsibility of the courier, not 4th Base Marketing LLC.
  2. 4th Base Marketing LLC does not take returns or exchanges.

V. Fraud

  1. Any user suspected of fraud, whether it be with a sponsor or strokenut.com, will be placed on hold and with all credits forfeited
  2. We reserve the right to screen all referrals (if applicable) for signs of fraud. We reserve the right, in our sole discretion, to determine which referrals are fraudulent, and to not disclose the reasoning behind this decision in order to protect our verification methods.
  3. Evidence of fraud may be reported to law enforcement

VI. Account Disqualification & Termination
  1. Common reasons for account disqualification:
    1. A chargeback or use of fradulent credit card for site subscriptions.
    2. Fraudulent referrals (if applicable).
    3. Negative feedback from any of our affiliates.
    4. Sending your referral link (if applicable) to others in an unsolicited or excessive manner (this includes but is not limited to: email, instant messages or chat rooms) or posting your referral link in newsgroups or online forums where not allowed.
    5. The use of any software, hardware, service or technique to hide or disguise your identity or IP address is not allowed. This includes the use of any proxy server/service which is not part of your internet service provider. Furthermore, using an internet service provider whose purpose is to provide anonymous internet access is not allowed.
  2. Additional Terms of account disqualification:
    1. We reserve the right to disqualify a user's account at any time should they be in violation of any of the terms & conditions outlined in this document.
    2. We are not responsible for notifying a user that his or her account has been disqualified.
    3. If an account is disqualified for any reason, All orders will be cancelled. All credit will be forfeited.
    4. If a user feels that he or she has been disqualified due to a mistake or misunderstanding, he or she may contact us via our web site. We do not guarantee any user will be able to get their hold/disqualified status reversed.
    5. We reserve the right to follow up legally on fraudulent activities.
    6. If a user has accounts on more than one 4th Base Marketing web site and any of the user's accounts are disqualified due to fraudulent actions, all of the users accounts on all other 4th Base Marketing web sites will also be disqualified.
    7. We are not obligated to fully disclose the reasons for a disqualification if doing so may compromise our fraud detection methods.
    8. This agreement may be terminated by 4th Base Marketing, for any reason, with or without cause, at any time.
  3. An account is considered "idle" if it has not been accessed via a valid login by the account's owner in 12 consecutive months (1 year). Such accounts may be disqualified and terminated without notice, in which credits in the account are forfeited.

VII. Credits

  1. Member understands that, in some cases, there may be delay in crediting for promotions of advertisers or partners due to advertiser's or partner's failure to provide necessary information to 4th Base Marketing LLC for such crediting. 4th Base Marketing LLC will not be responsible or liable for the delay or failure to issue credits in such event.
  2. 4th Base Marketing LLC reserves the right to adjust your credit balance with award reversals for transactions not completed or cancelled.
  3. The number of credits required to redeem for a reward are subject to change at any time without notice.
  4. The number of credits given for a subscription or sign-up are subject to change at any time without notice.
  5. Credits are non-transferrable and have no cash value.
  6. Credits do not currently expire. However, 4th Base Marketing LLC reserves the right to implement a point expiration policy in the future. (Accounts DO expire, in which case credits are forfeited. See above "Account Disqualification and Termination")
VIII. Other Information
  1. 4th Base Marketing LLC is allowed to place any account on hold for any reason.
  2. 4th Base Marketing LLC is allowed to deny credit for any offer for any reason.
  3. 4th Base Marketing LLC is allowed to cancel a users order for any reason.

Limitation of Liabilty

4TH BASE MARKETING LLC SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL, RELATING TO THE PARTICIPATION OR INABILITY TO PARTICIPATE IN STROKENUT.COM. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

Member acknowledges and agrees that 4th Base Marketing LLC neither endorses the contents of advertisements or third parties' Web sites, nor assumes responsibility or liability for the accuracy of material contained therein, or any infringement of third party intellectual property rights arising therefrom, or any fraud or other crime facilitated thereby.

Member agrees to indemnify and hold 4th Base Marketing LLC, its affiliates, officers, and employees harmless from any claim, demand, expense, or damage, including reasonable attorneys' fees relating to use of strokenut.com or violation of this Agreement.
